This clause identifies the law which governs these Terms and Conditions, together with any separate agreement under which the Company provides products or services, and identifies the forum in which a dispute is to be heard. That law is the law of Malaysia, applied without regard to its conflict of law provisions.
By accessing or using the website and the services, the Customer accepts each of the matters set out below.
Exclusive Jurisdiction
Any dispute, controversy or claim arising out of or relating to the use of this website, to a transaction made on it, or to the breach, termination or invalidity of these Terms, falls to be determined under the exclusive jurisdiction of the courts of Malaysia.
Waiver of Venue Objections
The Customer waives any objection to the venue of such legal proceedings, whether advanced on the ground of an inconvenient forum or on any similar basis.
Compliance Abroad
No representation is made by the Company that its materials, its products or its services suit any location beyond Malaysia, or are to be had there. A Customer who reaches the site from abroad bears responsibility for compliance with applicable local laws.
None of this is stated as a threat of litigation. It is stated in advance so that neither party is left guessing where a disagreement would be settled.
